1. TERMS OF DELIVERY
SHOPPING CONDITIONS – these terms and conditions apply to each and every purchase made by the BUYER on the website www.mokausianglu.lt
SELLER – IV ,,Mokausi English”, No 1310086, whose goods and services are sold on the website www.mokausianglu.lt and who is responsible for the execution of the order placed by the BUYER.
PURCHASER – a legal or natural person who is able to act and who purchases services and goods from www.mokausianglu.lt
PARTIES – the Buyer and the Seller together.
ACCOUNT – a dashboard that stores the personal data and order history of a customer on the website www.mokausianglu.lt.
CONTRACT – A contract of sale between a buyer and a seller, which is deemed to be concluded when the order is confirmed and the goods and services are paid for.
Before placing an order, the Buyer must tick a box to confirm that he/she has read and accepts the terms and conditions for delivery, delivery and refund of goods and services. The rules thus approved shall become a legal document setting out the rights and obligations of the Parties, the procedure for the purchase, delivery and return of the goods or services, the Parties’ responsibilities and other terms and conditions of the website www.mokausianglu.lt.

ENGLISH LANGUAGE LESSONS – contact or distance lessons, paid in advance by arranging the lesson time with the teacher. After payment, a confirmation email is sent to the Buyer with the Buyer’s personal timetable.
LEARNING MATERIALS SETS are exercises, stationery and other learning materials which, after payment, are sent to the Buyer by registered mail within 2-4 working days. The shipping fee is 2.80 EUR.
DIGITAL LEARNING FILES is a PDF educational material that can be downloaded 2 times to the Buyer’s devices after payment.
GIFT COUPON – a paper voucher with a unique number and a value of €25.00, which is sent by registered mail with a small gift after payment. There is an additional shipping fee of 2.80 €. The voucher can be used to pay for goods and services on www.mokausianglu.lt by entering the unique number.
A DIGITAL GIFT VOUCHER is a voucher with a value of EUR 25 which is sent by email after payment. A digital gift voucher has a unique number which must be entered on www.mokausianglu.lt when paying for goods or services.
Customers wishing to pay for services or goods with a gift voucher must enter the unique number of the gift voucher in a special field when placing their order.
BUYING – SELLING RULES – these are the rules that apply to each and every purchase made by the Buyer.
Once the order has been placed, the Buyer and the Seller shall be deemed to have entered into a legal relationship of sale and a contract of sale shall be concluded.
The Buyer is informed of the payment confirmation by a notification sent by email.
Each Buyer’s order is stored in the Seller’s database in accordance with the Privacy Policy.
The Buyer shall have the right to purchase goods and services on the website www.mokausianglu.lt in accordance with the procedures set out below.
The Buyer shall have the right to cancel the order and terminate the Contract in accordance with the procedure set out in the Rules.
The Buyer, using this website, is obliged to fulfill his/her obligations, to comply with these Rules, the Privacy Policy and not to violate the legislation of the Republic of Lithuania.
The Seller undertakes to execute the Buyer’s orders in accordance with the procedure set out in these Rules and to comply with the Privacy Policy.
The Seller undertakes to respect the Buyer’s privacy, to process the Buyer’s personal data only in accordance with the Rules, the Privacy Policy, the legislation of the Republic of Lithuania and the EU and to fulfil its obligations as the Seller.
The prices of goods and services on www.mokausianglu.lt are quoted in euros.
The Buyer may pay for goods and services on www.mokausianglu.lt by electronic banking.
Receipts are issued to individuals on request.
Invoices are issued to legal persons for goods or services purchased on the website www.mokausianglu.lt
An order is confirmed when the Seller receives payment for the goods or services.
Goods and services shall be provided in accordance with the procedures set out in the Rules.
The Buyer shall be liable for any unauthorised acts committed through the use of the www.mokausianglu.lt website.
It is forbidden to copy and distribute the information contained on www.mokausianglu.lt without the consent of IV ,,Mokausi English”. The Buyer shall be liable for illegal distribution of the material and other illegal acts in accordance with the laws of the Republic of Lithuania.
In case of violation of the rules, the Buyer’s access to www.mokausianglu.lt may be suspended indefinitely.
Any disagreements arising from the application of these Rules shall be settled by negotiation. In the event of failure to reach an agreement, disputes shall be settled in accordance with the procedures established by the legislation of the Republic of Lithuania.

2. CONDITIONS FOR THE RETURN OF GOODS AND MONEY
TERMS AND CONDITIONS OF MERCHANDISE AND REFUND – these terms and conditions apply to each and every purchase made by the PURCHASER on the website www.mokausianglu.lt
Returns of goods and services are subject to the procedures laid down in the legislation of the Republic of Lithuania.
If the buyer starts an order and does not complete it, the sale and purchase transaction is deemed not to have taken place.
INDIVIDUAL ENGLISH LESSON is a 45-minute lesson with only one student. Lesson price 15 €. English lessons are paid in advance by bank transfer. Payment for lessons is only made by arranging the lesson time with the teacher.
Lessons are not charged only in case of illness or 2 days’ notice of absence.
In the event of early termination of education, at the request of the pupil, when the money paid by the pupil has not yet been used, no refund will be given.
In case of early termination of education, unused tuition money is refunded to the student at the teacher’s request.
GIFT VOUCHER is for the purchase of English lessons and learning resources.
Gift vouchers can be purchased for EUR 25. Gift vouchers are valid for one year from the date of purchase. Each gift voucher has its own unique number and expiry date.
Money for unused gift vouchers is non-refundable.
The paper gift voucher is sent by registered mail and the digital gift voucher is sent by email.
The homeware can be returned within 14 working days if it is undamaged (see the Returns and Exchanges Policy for details). If the Buyer has received an item that was obviously damaged during shipping, then a new identical item will be replaced free of charge.
The SINGLE FILES, which can be downloaded 2 times by the Buyer to his/her devices after payment, are non-refundable. If the PDF file does not open, the Buyer must inform the Seller by email: uzsakymai@mokausianglu.lt The Buyer will be sent a description of how to use the digital files, and if the instructions do not help, then the Buyer will be sent a new digital file free of charge by email.
RETURN AND CHANGE RULES

1.
DEFINITIONS
1.1. Seller – IV ,,Mokausi anglų”, legal entity code 1310086, address Dariaus ir Girėno g. 4B-37, Kelmė.
1.2.You / Buyer – a natural person who, in accordance with the applicable legislation, is able to enter into transactions and who purchases goods for personal consumption (not for business purposes).
1.4 Rules – these Rules, which set out the rules for the return and exchange of goods purchased in the E-Shop.
1.5 Parties / Party – the Buyer and the Seller, either jointly or individually.
1.6 Goods / services – everything that is sold in the E-Shop. Hereinafter referred to as ‘goods’ includes services where goods and services are sold on the E-Shop, unless otherwise stated in the Terms and Conditions.
2. GENERAL PROVISIONS
2.1 These Terms and Conditions set out the rights and obligations between the Buyer and the Seller and the Seller’s responsibilities and liabilities in relation to the return and exchange of goods purchased on the E-Shop.
2..2 These Rules form part of the general general rules for the purchase of goods in the E-shop, which can be consulted here: www.mokausianglu.lt/lt/S-LYGOS/.
3. RETURN, EXCHANGE OF GOODS
3.1 The Buyer shall have the right to withdraw from the contract of sale and purchase of goods purchased in the E-shop, except for the contracts referred to in Article 6.228, Paragraph 2 of the Civil Code of the Republic of Lithuania, without stating a reason, within 14 (fourteen) days of the delivery/receipt of the goods, without giving any reason.
3..2. In order to return the quality product(s), the Buyer must notify the Seller in writing (by e-mail) and fill in the return form available at uzsakymai@mokausianglu.lt. The Buyer may also submit the return form to the Seller when returning the goods. The Buyer must return the goods no later than 14 (fourteen) days from the date of delivery (receipt) of the goods.
3.3 In the case of the return of quality goods, the Buyer shall be responsible for ensuring that the goods are properly packed for return. The Buyer shall bear the direct costs of returning the goods, unless the Seller specifies otherwise after the receipt of the notice of cancellation by the Buyer.
3.4. Non-digital goods may be returned.
If the Buyer has received an item that has been damaged during shipping, then the Buyer must send a photo of the damaged item to: uzsakymai@mokausianglu.lt and a new item will be sent free of charge within 2-4 working days.
3.5. The Buyer shall be refunded the price of the returned item, including any amounts paid by the Buyer for shipping, once the goods are returned to the Seller.
3.6..7. The Seller shall not be deemed to be in breach of the refund conditions if the Seller is unable to transfer the money due to the Buyer’s fault (delay in returning the goods, inaccurate data, etc.).
3.8. The following conditions shall be complied with in the event of the Buyer returning the goods:
3.8.1. the returned goods shall be in their original or other type of packaging in good order;
3.8.2. the returned goods must be undamaged by the Buyer;
3.8.3. the returned goods must be unused, without loss of merchantable appearance (labels, protective films intact), this point does not apply in the case of returning low-quality goods);
3.8.4. the returned goods must be in the same configuration as received by the Buyer;
3.8.5. when returning the goods, it is necessary to present the invoice confirming their purchase and to fill in a free form return request by contacting
3.9. If the returned goods are not complete, damaged, faulty and/or improperly packaged, the Seller shall have the right not to accept the returned goods and not to refund the money paid by the Buyer for the returned goods.
3.10. In the event of the sale of faulty Goods, the Buyer may request the replacement of the faulty Goods with a suitable Goods, a reduction in the price of the Goods, the return of the Goods and a refund of the money paid for the Goods. Replacement and return of defective goods shall be carried out in accordance with the procedure set out in these Rules and the legislation of the Republic of Lithuania.
3.11. The Buyer may not return such goods, the return of which is not provided for by the legislation of the Republic of Lithuania.
3.12 In the event of defective services, the Buyer shall be entitled to demand the elimination of the defects in the provision of services, the refund of the price paid for the services, and a reduction in the price of the services.
4. FINAL PROVISIONS
4.1 These Terms and Conditions shall be governed by the applicable legislation of the Republic of Lithuania and the European Union.
4.2 The Seller shall be entitled to change the Terms and Conditions at his/her own discretion, unilaterally, and without further notice. The amendments shall come into force from the moment of their placement in the E-shop and shall be binding on the Buyer wishing to use the E-shop.
4.3. The Seller may at any time assign its rights and obligations arising from these Terms and Conditions to third parties without the Buyer’s consent and without notice to the Buyer.
4.4. In the event of any disagreements arising between the Buyer and the Seller, they shall be settled by negotiation. In case the parties fail to reach an agreement, the disputes shall be finally settled in accordance with the procedure established by the laws of the Republic of Lithuania.
4.5 The Buyer-Consumer may submit a request and/or a complaint regarding the goods or services purchased in the Shop to the State Consumer Rights Protection Service (Vilniaus g. 25, 01402 Vilnius, tel. 8 5 262 67 51, fax. 8 5 279 1466, e-mail tarnyba@vvtat.lt, website www.vvtat.lt, its territorial units in the districts) or fill in the application form on the Electronic Consumer Dispute Resolution Platform available at http://ec.europa.eu/odr/. This clause does not apply to Business Buyers.
